Why we keep hitting send on damning emails

With so many business scandals lately, there?s often a damning email exposing wrongdoing, often sent by high-level employees.

Just last week, government officials investigating the collapse of MF Global released an email from the firm?s assistant treasurer that could implicate the CEO, former New Jersey Governor Jon Corzine.

The email states: ?Per JC?s direct instructions? millions of dollars were transferred out of customer accounts to cover a shortfall at the accounting firm, an act that could spell legal problems for both Corzine and the treasurer.

Email evidence like this isn?t unusual. Last year, an investigation into phone-hacking charges at News Corp. unearthed damning emails that showed top managers were informed about widespread illegal activity. And even the Oracle-Google patent fight has a ?damaging email? that is part of the saga. According to a recent article in Computer World, Google has been trying to keep an email written by one of its engineers out of the case.

So, the question is, why do people keep putting potentially harmful information in emails? Sure, it?s great for prosecutors who want to expose malfeasance at companies, but after so many public email faux pas you?d think people would have wised up.

One of the top reasons they haven?t is ?hubris,? maintained Dave Scher, an employment attorney with the Employment Law Group. ?People think they?re above the law.?

Scher represents employees in cases of retaliation or discrimination at work, and with about half of his cases he?s able to find emails that corroborate or confirm retaliatory or discrimination conduct.

One of the most blatant emails came from a boss who was pretending to be a licensed therapist. When his employees exposed him, the manager sent the worker an email basically stating he was firing him because he revealed his lie; a retaliatory move that?s illegal under labor laws.

Indeed, about a quarter of companies have had an employee e-mail subpoenaed as part of a lawsuit or regulatory investigation; and 9 percent ended up in court because of an employee email, according to the most recent report on business communications policies by the American Management Association and The ePolicy Institute. This despite that fact that about 80 percent of organizations have written email policies, the study found.

Stephanie Weiland Knarr, a licensed psychotherapist from Laurel, MD, isn?t surprised that people who engage in shady acts have no qualms about letting it all hang out on email. ?The personality type of someone who is engaging in illegal behavior is often narcissistic,? she explained, adding that they think they?re invisible and above the law. ?These types of people like to take risks and even if they?re caught and the writing is on the wall, so to speak, they still deny it.?

What may also be driving some of this is that many employees just don?t take email seriously, surmised Nigel Cannings, technical director for Chase Information Technology Services, a London-based firm that does corporate compliance.

?What we have found is that people just don't think of e-mail as ?real,?? he explained. ?To them it's an ephemeral thing that is sent off into the ether, and which is a) private, and which b) can be deleted. Usually, both are untrue.?

Indeed, in most cases you can?t just scrub your emails away if you realize they could be career killers, or land you in legal hot water.

?Depending on industry and the size of an organization, emails are immediately written to an enterprise repository, which is accessible by legal and compliance functions. And which cannot be deleted, even if they are deleted from the e-mail client,? Canning noted.

And, he added, ?Financial regulators insist that e-mails are maintained for potential later investigation. Increasingly this is the case for IM messages as well, and they are likely to be the next big area where people get caught out.?

It?s not just illegal deeds that are exposed via email. Patti Johnson, a career expert and the CEO of PeopleResults, said the email flubs she sees most include:

  • The misinterpretation: ?Emails are often misinterpreted because you wrote it quickly, used the wrong tone or copied the world. A poorly worded or quickly written email can send the relationship in a downward spiral because it is misinterpreted.?
  • The misused CC: "This is often the equivalent of saying I need to let your boss know because I'm not sure you will get it done, or I need someone else to be involved. Use the CC with intent or you can end up with a trust issue on your hands unintentionally.?
  • The address mixup: ?Emails sent to the wrong person. Yes, it happens and it isn't pretty. You type the person's name in you are complaining about.?
  • The angry: ?Emails sent when you're mad. This is time to take a deep breath and make sure you have the facts and pause. A good rule of thumb is if you are going to send a flaming email out, sleep on it first or at least walk around the block. Because once it goes - you can't get it back.?

In the end, emails are ?permanent and very, very mobile,? stressed Margaret King, director of a consumer research think tank, The Center for Cultural Studies & Analysis.

?Never put anything in an email that you would not want quoted in the New York Times,? she advised. ?If the material is that sensitive, ask the recipient to give you a call, and transmit that way.?

Gold edged higher on Friday, helped by a drop in the U.S. dollar to one-month lows, but prices remained in a narrow range ahead of a meeting of euro zone finance ministers later in the day to discuss increasing the bloc's bailout fund.

Spot gold inched up 0.1 percent to $1,663.11 an ounce at 0950 GMT. The metal is on track for a 6 percent gain in the first three months of 2012, after posting its first quarterly drop in three years at the end of last year.

"All in all gold is still holding fairly well because the U.S. dollar weakened, which gave gold some support," said Peter Fertig, a consultant at Quantitative Commodity Research.

"Gold had a very good start and run-up until the end of February and it's now consolidating part of the gains in March."

He said in the coming weeks gold could consolidate further, with risks to the downside. "The stock markets came under pressure this week and also crude oil retreated somewhat and these have been factors which were negative for gold," he said.

Oil prices rose above $123 on Friday after falling sharply earlier in the week.

The dollar hit a one-month low against a basket of currencies on Friday, dragged down by heavy selling against sterling. A weaker dollar tends to boost gold, which is priced in the U.S. currency.

Risk appetite sharpened on Friday, with safe-haven German bunds flat, while world stocks rose as equity markets picked up gains at the end of the quarter and investors eyed a boost to the euro zone's bailout resources that ministers are expected to sign off on later in the day.

Investors expect the euro zone finance ministers' meeting later in the day to deliver an agreement on temporarily almost doubling the bloc's bailout capacity as one of the final moves to end its debt crisis.

Gold investors largely held off taking fresh positions ahead of the meeting, which may have a significant effect on the currency markets.

While euro zone worries helped drive gold to record highs last year, the metal has since re-established its usual inverse relationship with the dollar so that good news from the bloc, which boosts the euro and weighs on the dollar, tends to be positive for gold.

"In the near term, gold prices may be influenced by the effectiveness of the euro zone's plan to bolster their bailout fund," HSBC analysts said in a note.

"If the investors deem the plan as sufficient in reducing near-term euro zone liquidity issues, we believe risk assets including gold may benefit," they added.

U.S. gold futures for June delivery were up $10.80 an ounce at $1,665.70.

Silver was up 0.8 percent at $32.46 an ounce. The gold/silver ratio, or the number of silver ounces needed to buy an ounce of gold, eased back towards 51 on Friday.

Spot platinum was up 1.2 percent at $1,641.70 an ounce and is on track for its best quarterly performance in three years, up 17.6 percent. Palladium was up 1.1 percent at $649.22 an ounce.

South Africa's government is to plough $420 million into a public-private platinum venture with Pallinghurst Resources that has ambitions to become the world's third-largest producer of the precious metal, Pallinghurst said on Thursday.

The partnership, which includes the local Bakgatla Ba Kgafela tribe, has a production target of 1.1 million ounces within the next five years. AUGUSTA, Ga. Researchers want to help the Army better camouflage its soldiers and break the enemy's efforts to hide.

"We want to make our camouflage unbreakable and we want to break the camouflage of the enemy," said Dr. Jay Hegde, neuroscientist in the Medical College of Georgia at Georgia Health Sciences University.

Hegde and GHSU Postdoctoral Fellow Dr. Xing Chen are using a relatively simple technique they developed to teach civilian volunteers to break camouflage. They flash a series of camouflage pictures on a computer screen, providing about a half second after each to spot, for instance, a face in a sea of mushrooms. A green light signals a correct answer and a red light signals an incorrect answer. The computer-generated images include distractions to make the difficult task even more challenging.

They are finding that an hour of daily training in as little as two weeks results in proficiency for 60 percent of the mostly college and graduate school students who have signed up for their training. The Army's current approach is taking soldiers into battlefield situations to hone these skills.

As part of a three-year grant from the Office of Army Research, the researchers want to determine which parts of the brain light up when trained snipers break camouflage.

"We need to figure out how the expert camouflage-breakers do it," Hegde said. "We want to figure out what parts of the brain are most responsive when people break camouflage and, a related experiment is what part of the brain changes its response when people learn to break camouflage." Their techniques include functional magnetic resonance imaging to measure blood flow activity as an indicator of brain cell activity.

Figuring out which parts of the brain are involved could give the Army and others a better way to identify future first-rate snipers and objectively assess instructional efforts.

"If you are the Dean of the Army Sniper Corps and want to develop top-notch snipers, you don't want to spend a year training them before giving up on half of them," Hegde said. A brain scan could help signal whose relevant areas are well developed and, consequently, have natural skill.

Early evidence points toward two regions of the temporal lobe, found on either side of the brain and known to have a role in speech and vision. A region called the fusiform gyrus which plays a role in facial recognition and lights up when people become experts at recognizing various objects, such as a particular bird species may be important in breaking camouflage as well.

Hegde suspects that expertise at breaking camouflage stems from the fusiform gyrus in combination with some other area(s) of the brain. And, because good recognition skills don't typically translate from one area to another, he also suspects that the parts of the brain involved vary with the object of their attention. For example, the ability to easily recognize the make and model of a car doesn't guarantee skill at breaking camouflage and Hegde notes that some military snipers aren't good at game-hunting.

Vision happens when light enters the retina where photoreceptor cells turn it into signals that are interpreted by the brain. "If there is a whole lot of light falling on them, they send a lot of signals, beep, beep, beep," he said in rapid succession. "If there is a little bit of light they fire slowly." The brain connects the dots to form a familiar face or landscape. Camouflage complicates the task the difference between recognizing a mountain goat against a clear blue sky and finding a moth among a pile of fall leaves.

"Here is the beautiful thing that we are finding out: if you know what you are looking for, the next time you can break the camouflage of the moth. Without knowing what you are looking for, the picture also is ambiguous," Hegde said.

The brain connects the dots to form a familiar face or landscape. Camouflage complicates the task the difference between recognizing a mountain goat against a clear blue sky and finding a moth among a pile of fall leaves.

"Here is the beautiful thing that we are finding out: if you know what you are looking for, the next time you can break the camouflage of the moth. Without knowing what you are looking for, the picture also is ambiguous," Hegde said.

US still fixated by nuclear terror

Visions of a mushroom cloud over a US city may have led America into a dubious war in Iraq, but the threat of nuclear terror has lost none of its power to fixate US leaders and shape foreign policy.

President Barack Obama put counter proliferation at the center of his political project, earning himself a Nobel Peace Prize, and has worked to secure radioactive material around the globe ever since.

He arrives in Seoul for the second Nuclear Security summit on Sunday in the next step in that quest, though the meeting will be overshadowed by nuclear standoffs with Iran and North Korea.

Views among scientists differ on whether a terror group like Al-Qaeda could build and detonate a primitive nuclear bomb on a US city.

But no president will take the threat lightly after seeing the impact of mass terrorism wreaked by the September 11 attacks in 2001.

Obama said while hosting the first nuclear summit in Washington two years ago that a nuclear strike on a major populated area could change the global security landscape for years to come.

"The ramifications economically, politically and from a security perspective would be devastating," he said.

Analysts say that Obama's concern is justified.

"What we have seen is increasing evidence of intentions... it is not just Al-Qaeda, it is other organisations as well," said Sharon Squassoni, of the Center for Strategic and International Studies.

"It is pretty shocking how much material is out there. 1440 tonnes of highly enriched uranium, 500 tonnes of separated plutonium (which is) weapons ready."

Between 33 and 110 pounds (15 to 50 kilogrammes) of uranium enriched to 90 percent could make a simple nuclear bomb, while 14 pounds (6 kilogrammes) of plutonium would be needed, according to the Union of Concerned Scientists.

Obama's globe trotting has been pared back to a minimum in election year, but his willingness to fly half way around the world to Seoul points to the severity of the nuclear threat.

"You have dozens of nations coming together behind the shared goal of securing nuclear materials around the world, so that they can never fall into the hands of terrorists," said Ben Rhodes, a deputy national security advisor.

Failure, he said, would result in "frankly, ... the gravest national security threat that the American people could face."

Efforts to secure radiological material, in militaries, laboratories or medical establishments are at the center of the broad US agenda with states as diverse as Russia, China, Chile, South Africa, the Ukraine and even ally Canada.

The issue shapes foreign policy -- luring Obama into dialogue with leaders like Kazakh President Nursultan Nazarbayev, despite his poor State Department report card over abuses of political, judicial and press freedoms.

Nazarbayev has earned a meeting with Obama after his cooperation to help secure highly enriched uranium and plutonium with the help of millions of dollars in US taxpayer money.

Analysts say the Obama-led effort to secure nuclear stocks has made progress since the Washington summit -- though there is still some way to go.

"I think America is absolutely safer now than it was three years ago," said Kingston Reif of the Center for Arms Control and Non Proliferation.

"Seven countries have removed all their highly enriched uranium. That is material that is no longer capable of being used by terrorists in some kind of nuclear explosive device."

While America works to secure radioactive stockpiles in the former Soviet Union and elsewhere, senior US officials also worry that a state like Iran or North Korea could pass nuclear materials to a radical group.

Obama deploys one argument against Iran that is strikingly similar to one used by his predecessor George W. Bush to justify the 2003 invasion of Iraq, on the basis of Saddam Hussein's never found weapons of mass destruction.

"There are risks that an Iranian nuclear weapon could fall into the hands of a terrorist organization," he told the US-Israel lobby AIPAC recently.

The showdowns with Iran and North Korea challenge the case that Obama's nuclear agenda, rolled out in a soaring speech in Prague in 2009 is a success.

But experts say, Obama has made some real progress, with 80 percent of commitments made at the Washington summit fulfilled.

He honored a vow to forge a new START treaty with Russia to reduce Cold War nuclear arsenals but is still trying to persuade the Senate to ratify the Comprehensive Test Ban Treaty.

Slow headway is being made meanwhile towards an updated Nuclear Non Proliferation Treaty (NPT).

Etch A Sketch maker happy to be back in spotlight, sends boxes of toys to candidates

Ohio?Art?Co., maker of the classic baby boomer toy, is sending a big box of Etch A Sketches to the presidential campaigns to say thanks for the publicity and a boost in sales.

Pushed to the bottom of the toy box by video games and other high-tech gadgets, Etch A Sketch is suddenly drawing lots of attention, thanks to a gaffe that has shaken up the race for the White House.

Ohio?Art?Co., maker of the classic baby boomer toy, is sending a big box of Etch A Sketches to the presidential campaigns to say thanks for the publicity and a boost in sales.

It all started when Mitt Romney strategist Eric Fehrnstrom was asked Wednesday about the candidate's politics now versus next fall, and he likened the campaign to an Etch A Sketch: "You can kind of shake it up and we start all over again."

Democrats and Republicans alike seized on the remark as evidence that Romney is a flip-flopper willing to alter his positions for political gain.

GOP rival Newt Gingrich told voters in Louisiana that "having an Etch A Sketch as your campaign model raises every doubt about where we're going." Rick Santorum brandished an Etch A Sketch and told voters he is a candidate who stands "firmly on the rocks of freedom, not on the sands of an Etch A Sketch toy." Santorum's staff also handed out miniature Etch A Sketches to reporters.

While Romney's opponents are hoping the remark will erase his momentum and reframe the debate, the biggest winner might be?Ohio?Art.

Its stock, which trades over the counter, nearly tripled on Thursday, closing at $9.65, and major stores reported a jump in sales, said chairman Bill Killgallon.

"We're proud that one of our products is shaking up the debate," he said.

Ohio?Art?has sold more than 100 million Etch A Sketches worldwide since its introduction in 1960. The toy, with its familiar gray screen and bright-red frame, allows youngsters to draw things by twisting two white knobs. A quick shake erases the image and lets you start over.

Etch A Sketches were made in?Ohio?until 2000, when the?company?moved production to China because of increasing costs.

Over the years,?Ohio?Art?and Etch A Sketch have benefited from millions of dollars in free advertising from movies and television. The?company?saw a big jump in sales after Etch A Sketch landed a role in "Toy Story" and "Toy Story 2."

In fact, the toy gets so much free publicity that?Ohio?Art?spends very little on advertising it.

The?company, based in Bryan, doesn't release annual sales figures but says Etch A Sketch has a steady market. It's most popular with grandparents and mothers who are looking for a bit of nostalgia.

How long the latest bump will last is anybody's guess.

"I'm not sure that just because the candidates are talking about Etch A Sketch that kids are going to tell their moms to go out and buy one," said Martin Killgallon, the?company's?marketing director.

One thing the Etch a Sketch won't do is pick sides in the presidential campaign, he said.

"We have a left knob and a right knob," he said, "so we neutrally speak to both parties."

Extremist suspect upends French presidential race

PARIS (AP) ? French far-right presidential candidate Marine Le Pen says her anti-Islam agenda has been vindicated: A French Muslim claiming ties to al-Qaida has taken responsibility for the country's worst killing spree in years.

The specter of radical Islam's grip on France has threatened to overturn France's presidential race, in which Socialist Francois Hollande has long been the pollster's favorite to unseat the divisive conservative president, Nicolas Sarkozy.

Le Pen, the No. 3 candidate in polls, said France must "wipe out" the Islamist threat, saying it has been minimized by authorities.

Sarkozy has borrowed from Le Pen's playbook in campaigning for the presidential election on April 22 and its expected runoff May 6, with talk of halving immigration and lamenting widespread availability of halal meat.

It's too soon to tell definitively how two-day standoff with suspect Mohamed Merah, 23, could affect Sarkozy's chances for a second term. Merah, who bragged to police about killing seven people in an effort to "bring France to its knees," died Thursday in a shootout with police in Toulouse.

Still, a poll released Thursday suggested that Sarkozy may benefit politically from the horror of recent days.

The survey by CSA suggested Sarkozy would slightly dominate the first round of voting in April but lose to Hollande in the May runoff by 46 percent to 54 percent.

Support for Le Pen was notably down. The poll was conducted Monday and Tuesday, after a rabbi and three children were shot dead at a Jewish school but before details about the suspect Merah emerged. A total of 1,003 people were questioned by telephone.

In many French minds now lurks the memory of Spain's 2004 election, which came three days after deadly train bombings in Madrid by Islamic terrorists. In that case the incumbent conservatives had expected to win but lost at the last minute to the Socialists.

In the United States, continued worries about terrorism and security after the Sept. 11 attacks had the opposite effect, helping to bring George W. Bush a second term in 2004.

Le Pen's far-right National Front claims that so-called Islamization is corrupting the French culture and will change France if no one acts against the influx of Muslim immigrants and the growing demands of Muslims born on French soil.

France has an estimated 5 million Muslims ? the largest such population in Western Europe ? and many have long worked to defeat chronic and ambient discrimination within French society. Anti-Muslim sentiment tends to peak with international tensions like the Palestinian intifada or the Sept. 11, 2001, al-Qaida terror attacks.

The revelation that the chief suspect in three deadly attacks this month in the Toulouse region in southwest France was a Frenchman of Algerian origin who claimed al-Qaida ties and traveled twice to Afghanistan resonated among candidates and put Muslims on the defensive.

After authorities identified Merah, a man with a long record of petty crimes, Muslim and Jewish leaders joined in a single voice to warn against any bid to stigmatize Islam.

"Muslims like Jews, Jews like Muslims, and condemn all confusion that might be made between the international political situation in the Middle East and the monstrous act that ... has horrified all French," the Grand Rabbi of France Gilles Bernheim said Wednesday after meeting with Muslim leaders and Sarkozy.

Mohammed Moussaoui, president of the CFCM, an umbrella group for French Muslims, said what the suspect has done "is the very negation of ... Islam," on the France-2 TV network.

The powerful fundamentalist Muslim organization UOIF asked all citizens "not to succumb to the panic of stigmatizing Muslims, which feeds Islamophobia."

In the case of Le Pen, it may already be too late.

"We have underestimated, I think, the rise of radical Islam in our country," Le Pen said. "We didn't want to see it, out of weakness or for electoral reasons, that recruiting is going on in our neighborhoods by political-religious groups."

Le Pen, who called national attention to the numbers of Muslims who pray in Paris streets for lack of space in prayer rooms, was among six presidential candidates present at Wednesday's solemn funeral services for three dead paratroopers in the city of Montauban, near Toulouse. Merah had claimed responsibility for those attacks.

Le Pen had stayed away from mourning prayers after Monday's killing of the Jewish rabbi and the children ? when investigators focused their search on neo-Nazis and extreme rightists. Le Pen's National Front has long been seen as a vehicle to spread anti-Semitism.

Hollande said the fight against terrorism is "the combat of the entire nation," above all else.

Centrist presidential candidate Francois Bayrou said the slayings around Toulouse pose the question of "the state of French society, where there are explosive germs" and the "risk of importing conflicts" onto French soil.

Sarkozy, speaking as president at Wednesday's funeral ceremony for the paratroopers, vowed that terrorism "won't manage to fracture our national community."

However, Sarkozy has followed the lead of Le Pen in the past, allowing her to set the agenda so he can take up her themes and go after her far-right followers.

A young man in Toulouse who slightly knew the suspect said he was shocked and afraid.

"This person doesn't represent me," said Mehdi Nedder, 31. "What worries me is what society will say tomorrow in the bakery shops, at the butcher's or at the post office."

Lululemon profit rises, outlook disappoints

(Reuters) - Lululemon Athletica Inc on Thursday offered a disappointing full-year profit outlook for its chain of trendy yogawear shops, offsetting a surge in quarterly earnings and sales, and leaving its shares little changed.

The Vancouver-based retailer's profit in the three months ended January 29 climbed 34 percent, slightly more than expected, while sales in established stores rose 26 percent.

The results were slightly ahead of a revised forecast the company had given in January after a stronger-than-expected holiday shopping season.

Even so gross profit margin tightened to 56.3 from 58.5 percent a year earlier, due to higher raw material costs and discounting to reduce stocks of unsold merchandise. Inventory at the end of the quarter stood at $104.1 million, up from $57.5 million a year earlier.

"Lululemon needed to just blow the earnings results out of the way, which was going to be hard" given January's forecast, said Brian Sozzi, chief equities analyst at NBG Productions, explaining the market's lukewarm response.

SUCCESS STORY

Lululemon, one of Canada's most successful retailing exports, has expanded rapidly in the United States. Its clothing and gear, ubiquitous in Canada and increasingly popular south of the border, inspires fierce brand loyalty, with bloggers breathlessly documenting every product launch.

The typically volatile stock was up 0.5 percent at C$73.91 in early trading on the Toronto Stock Exchange on Thursday.

The stock has risen more than 50 percent this year, and in recent quarters any sign that the company's growth might slow has spooked investors.

The market appears to have picked up such a signal when Lululemon announced a new full-year earnings forecast $1.50 to $1.57 a share. That fell short of the $1.61 that analysts had forecast.

Lulu also forecast full-year revenue of $1.3 billion to $1.325 billion, in line with analysts' earlier estimate of $1.308 billion.

INVENTORY REVERSAL

Sozzi said the inventory growth over and above sales at established stores - or same-store sales - would likely raise concerns that margins could deteriorate further in the first half of the year.

The decline in margins reversed a trend that prevailed for much of 2011, when inventories were low.

Last year, Lulu's premium yoga pants and other products sold faster than it could restock, which meant most products were sold at full price, but also held back overall sales.

The company has said several times that its now-higher inventory would help it better meet demand.

RBC Capital Markets analyst Tal Woolley said inventory was high, but noted it was still boosting sales.

"We believe this build is allowing (Lululemon) to maximize its business, play 'catch-up' less with product, and focus more on product development and innovation," he said in a note to clients.

BY THE NUMBERS

For its fiscal fourth quarter ended January 29, net income rose to $73.5 million, or 51 cents a share, from $54.8 million, or 38 cents, a year earlier. Analysts, on average, had expected earnings of 49 cents a share, according to Thomson Reuters I/B/E/S.

Total revenue rose 51.4 percent to $371.5 million, higher than analysts had expected, while same-store sales, a key measure for retailers, climbed 26 percent.

In January, the company said it expected same-store sales to rise more than 20 percent.

At the end of the quarter Lululemon had 174 stores in Canada, the United States and Australia, up from 165 at the beginning of the period.
